1CWP No. 10105 of 2014
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 10105 of 2014 Date of decision : 04.07.2017 Baljit Singh ....Petitioner V/s Union of India & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Jatinder Kumar Puri, Advocate for the petitioner. Mr. Arun Gosain, Advocate for respondent no. 1. Mr. Harsh Chopra, Advocate for respondents no. 2 & 3. Mr. Aman Sharma, Advocate for respondent no. 4. RAJAN GUPTA J.
Petitioner sought a writ in the nature of certiorari seeking quashing of order dated 20.06.2013, Annexure P-9 passed by respondent no. 2 whereby case of petitioner for grant of subsidy to set up a unit for processing turmeric has been rejected. Stand of the petitioner is that order passed by authority is arbitrary. No cogent reason has been assigned for rejecting the claim of the petitioner. Prayer has been opposed by learned counsel representing the respondents. It has been argued on behalf of respondent no. 2-Board that inspection of the unit was carried out on 05.06.2012. It was found that it was running unit and not a new setup. This was fortified by the fact that petitioner had already taken a loan from the Central Bank of India. Loan amount had been disbursed by the bank directly to the petitioner and not to the contractor/supplier. For this reason claim of the petitioner had been rejected. I find substance in the plea raised Ajay Kumar 2017.07.05 16:03 I attest to the accuracy and authenticity of this document
2CWP No. 10105 of 2014 by the respondents. There is no infirmity with the order passed. Besides a query has been put to counsel for the petitioner whether grant of subsidy is a right vested in him, no clear answer is forthcoming. No ground for interference in writ jurisdiction is made out. Petition is without any merit is hereby dismissed.
