******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.3 dated 23.01.2019 registered for the offence punishable under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Fattu Dhinga, District Kapurthala.

Heard.

As per case of prosecution, the petitioner was apprehended on 23.01.2019 and recovery of 113 gms. of intoxicant substance was effected from his possession.

Learned State counsel on instructions from ASI Sharanjit Singh submits that on receipt of FSL report, it transpired that powder recovered from possession of the petitioner was not a contraband. The police will initiate further action to get the petitioner discharged. In view of submission of learned State counsel, this petition is allowed and petitioner-Rajpal Singh @ Raju is ordered to be released forthwith.
