(Oral) Prayer in the instant revision is for issuance of directions to Civil Judge (Senior Division), Ludhiana to decide/ conclude the crossexamination of the petitioner/plaintiff in Civil Suit No. CS/2226/2018 in a time bound manner.

Ordinarily this Court would not have interfered in the instant proceedings, however, since the dispute essentially arises out of the matrimonial differences between the petitioner and the respondent. They are though mutually divorced, but yet as claimed by the petitioner, the respondent continues to be in unauthorised possession of her suit property. The petitioner has filed a civil suit claiming to be absolute owner of the suit property as the conveyance /title-deed is duly registered only in her favour. And yet, the respondent is not allowing her to use the same in the manner she wishes to. Taking advantage of the pre-divorced permissive possession given to him, he is now not handing over the possession to the petitioner-wife even after the divorce has taken place. Be that as it may, the claim of the petitioner is subject matter of the trial before the Court below and without making any observations qua merits thereof, which are left open to be decided by the Courts below, the instant petition is disposed of with the expectation that the trial court shall proceed with the matter, as expeditiously as possible, though of course, by observing all the pandemic precautions. It is made clear that this order shall not, in any manner, be construed to mean that pending trial is to be taken up out of the way, in case physical hearings have otherwise not resumed due to the reasons of pandemic.
