Learned counsel for the petitioner submits that the amendment carried out under Punjab Government National Emergency (Concession) Rules, 1965 vide notification dated 22.07.2005 is not applicable to the case of the petitioner as the services of the petitioner were regularized w.e.f. 01.01.1980 i.e. prior to the date, on which, the aforesaid amendment came into being i.e. 20.04.1981. In view of the information issued by the Additional Chief Secretary, Information, Public Relations and Languages Department, Haryana to the Director General, Information, Public Relations and Languages Department, Haryana, Chandigarh vide memo dated 06.03.2019 on the PRINCE SAINI 2023.01.25 19.27 I attest to the accuracy and authenticity of this order/judgment
subject matter of benefit of military services to the petitioner, the benefit is to be given to the petitioner from the date of appointment and not from the date of ad hoc appointment. [2].
In view of the claim of the petitioner for grant of benefit under Punjab Government National Emergency (Concession) Rules, 1965 with effect from the date on which the petitioner was initially appointed on ad hoc basis, the petitioner needs to assail the order (Annexure R-1) and communication issued in pursuance thereof (Annexure R-2) attached with the written statement filed by the respondents No.1 and 2. [3].
Faced with this situation, learned counsel for the petitioner wishes to withdraw the present petition with a liberty to file fresh petition with better particulars.
