The matter has been taken up through video conferencing in the light of the pandemic COVID-19 situation Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.32 dated 25.01.2020 under Section 22 of the NDPS Act, registered at Police Station Dabwali Sadar, District Sirsa. Heard on the petition.

As per version of the prosecution, on 25.01.2020, the petitioner Nanak Singh was intercepted by the police party along with 790 intoxicant prohibited tablets, make Alprozolam Tablets batch No.PRZ-19104, without any permit or licence in the area of Abub Shehar. CRM No.M-27807 of 2020 -2the petitioner is in custody since 25.01.2020 and the extent of alleged recovery is marginally above the commercial quantity. Though the challan has been presented but however, the conclusion of trial is likely to take time.

Learned State counsel does not dispute the aforesaid assertions. Thus, keeping in view the submissions so made, without giving any opinion on merits of the case and also keeping in view the duration of detention of the petitioner, without prejudice to the rights of the parties to be adjudicated during the course of the trial, the present petition, as such, is allowed. The petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds to the satisfaction of the trial Court.
