Prayer in the present revision petition is for deciding the application for stay which was filed alongwith an appeal before the First Appellate Court.

None has been appearing on behalf of the plaintiff-respondent despite service.

Learned counsel for the defendant-petitioners would contend that alongwith the appeal, which was preferred by the defendant-petitioners herein challenging the judgment and decree dated 09.10.2023 passed by the Trial Court, an application for stay was filed which is pending till date. Meanwhile, the plaintiff-respondent had filed the execution petition and without notice to the defendant-petitioners the Executing Court had directed that the sale deed be executed on or before 02.07.2024.

In the present petition notice of motion was issued vide order dated 29.05.2024 and status quo was directed to be maintained till the next date of hearing. However, despite service the plaintiff-respondent has not appeared.

In view of the limited prayer made by learned counsel for the defendant-petitioners, the present revision petition is disposed off with a request to the First Appellate Court to decide the stay application expeditiously and preferably within a period of one month from today. Till the application for stay is not decided, the execution of the sale deed shall remain stayed.

Disposed off in the above terms. Pending applications, if any, also stand disposed off.
