As per office report, notices to respondents No. 4 to 6 could not be issued as learned counsel for the petitioner has not complied with the previous order dated 10.07.2018.
Learned State counsel submits that the instant petition has rendered infructuous on account of filing of final report under Section 173(2) Cr.P.C. against one Aslam, declaring co-accused, Fajru, Wahidan, Kamru, Hakmudeen and Sakunat as innocent, during investigation. In view of the above, the instant petition is dismissed on following two counts:- (i) as having rendered infructuous; and (ii) for want of prosecution as well for not complying with the previous order dated 10.07.2018.
