Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the amount of revised 6th Pay Commission benefits of Gratuity, Leave Encashment and all other remaining benefits of the petitioner along with interest @ 18% for the delayed period, for which the representations dated 10.02.2026 and dated 18.03.2026 (Annexures P-4 and P-5, respectively) have been served by the petitioner.

Learned counsel for the petitioner submits that he would be satisfied if the representations dated 10.02.2026 (Annexures P-4) and dated 18.03.2026 (Annexures P-5) submitted by the petitioner are decided by respondent No.3 by passing a speaking order in a time bound manner.

Ms. Brea Sandhu, Advocate has put in appearance on behalf of respondents No.3 to 5 and file Memo of Appearance, which is taken on record. The Registry is directed to tag the same at appropriate place.

Learned State counsel, appearing on advance notice, as well as learned counsel for respondents No.3 to 5 submits that they have no objection, in case a direction is issued to respondent No.3 for timebound consideration and decision of the representations dated 10.02.2026 (Annexures P-4) and dated 18.03.2026 (Annexures P-5) submitted by the petitioner by passing a speaking order. 5.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.3 is directed to consider the representations dated 10.02.2026 (Annexures P-4) and dated 18.03.2026 (Annexures P-5) submitted by the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.3.
