Mr. Anil K. Bhardwaj, Advocate, for the petitioner Mr. Gurveer Sidhu, AAG, Punjab, for the respondents Fateh Deep Singh, J. (Oral) Learned State counsel, on instructions from Sh. Rohit Chaudhary, IPS, Additional Director General of Police (Prisons), Punjab, has made statement that the State Government has changed its stance qua pre-mature release of convicts and now the concession of pre-mature release is to be governed by the policy as on the date of initial conviction by the trial court and that the State is willing to consider representation of the petitioner which he would like to make and within one month of the receipt of the same, the State will dispose off the representation per this stand of the State to which the counsel for the petitioner has readily agreed.
In view of the stand of the State and consent shown by the counsel for the petitioner, the present petition is disposed off with the directions to the petitioner to make fresh representation for pre-mature release to the concerned authority and on receipt of the same within one Dalbir Singh Tiwana 2017.02.28 13:26 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.
Criminal Writ Petition No. 1074 of 2016 -2month, office of Additional Director General of Police (Prisons), Punjab shall pass appropriate orders thereon and also convey the same to the petitioner without loss of time. It is made clear that the concerned Reporting Officer i.e. concerned Deputy Commissioner/District Magistrate as well as concerned Commissioner of Police/Senior Superintendent of Police shall ensure that they respond to such query if any received from the office of ADGP (Prisons), Punjab within two days by all means on the receipt of the same.
The present petition stands disposed of.
