******* SURINDER GUPTA, J.(Oral) Learned State counsel submits that vide order dated 13.11.2018, two directions were given to the State, firstly, to consider the case of petitioner for promotion as a Project Officer on his completing three years of service with the deeming fiction that post of Stage Setter is surrendered instead of the post Project Officer and grant the petitioner consequential benefits of pay w.e.f August, 1988 by notionally fixing his pay on the said post. Secondly, the State was directed to consider the claim of petitioner for grant of pay scale of `2200-4000+300. Both the reliefs have been allowed to the petitioner. He has been promoted as a Project Officer on completing three years of service and his pay has also been fixed in the pay scale of `2200-4000+300 and consequential benefits have been allowed. This petition has been rendered infrucutous.

COCP-2203-2019 Learned counsel for the petitioner seeks permission to withdraw this petition to challenge the speaking order and to avail other legal remedies available to the petitioner.
