As is the stand of the State made in the reply by way of affidavit of Sh. Mohinder Singh, PPS, Deputy Superintendent of Police, Sub Division Attari, District Amritsar (Rural) that an FIR bearing No. 99 dated 20.7.

2016 under section 21 of the NDPS Act was registered with Police Station Gharinda, District Amritsar (Rural) against one Rajpal Singh @ Raja and 40 grams of heroin was recovered from him and that during the course of investigations, it was revealed that one Harjinder Singh @ Jinda who happens to be the kingpin of the Cross-Border smuggling of heroin along with Kulwinder Singh @ Raman and Reena Kumari were procuring contraband including heroin from Harjinder Singh @ Jinda and it was revealed that payment of this contraband being smuggled from CrossBorder was made to Naveen Bhatia who happens to be an Exporter Dalbir Singh Tiwana 2016.09.14 11:41 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh.

Criminal Writ Petition No. 1084 of 2016 -2exporting commodities to Pakistan from Poonch Border (Jammu and Kashmir) and happens to be the husband of Richa Bhatia. It is during the course of investigations that the petitioner was arrested on 29.7.2016 by police officials of Police Station Gharinda and sale proceeds of the contraband amounting to Rs 01 Crore 80 lacs was received by the petitioner. Since there is no representation on behalf of the petitioner and there has been recourse to law adopted and the petitioner is in judicial custody, nothing survives in the present petition and the same is dismissed.
