etitioner has filed this petition under Section 439 of Cr.P.C. for grant of regular bail in case FIR No. 558 dated 22.10.2021, registered under Sections 406, 420, IPC, at Police Station Sadar Yamunanagar, District Yamunanagar.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case, as he has nothing to do with the same; that the FIR was registered on the complaint of Bhisham Singh, alleging therein that the petitioner is doing the business of finance/chit fund in Yamuna Nagar and on his assurance many boys, serving in the Indian Army, opened their chit fund accounts with the petitioner and when they demanded their money back, Gulab Singh-father of the petitioner, abused and threatened them to kill and thus, this way the petitioner duped many persons to the tune of Rs. 44,20,000/-; that no money for opening the chit fund account has ever been received by the petitioner either in cash or cheque or demand draft; that MANGAL SINGH 2022.07.20 19:06 I attest to the accuracy and authenticity of this order/judgment

 






 

in order to grab money from the petitioner, he has been indicted in the present case; that it is a civil dispute; that the petitioner has been in custody since 07.12.2021 and that the charges stand framed but no prosecution witness has been examined so far.   Learned State counsel contends that there are specific allegations against the petitioner that he has duped the villagers of their hard earned money, as being a villager he was having connection with the co-villagers and on his assurance young boys serving in the Indian Army opened chit fund account. In total, the petitioner has to repay a sum of Rs. 44,20,000/- to the chit fund account holder. There are as many as 15 complainants against the petitioner.

     $ "Recovery of Rs. 44,20,000/- is to be effected from the petitioner.    Considering the nature of allegations against the petitioner, no ground is made out to grant regular bail to the petitioner is made out. In view of the above, the present petition is dismissed.
