H. S. Madaan, J. (Oral) The applicants-petitioners had filed an application for compensation against Union of India, on account of death of Varinder Sharma, in an untoward incident while travelling in a train. That claim petition was accepted by the Railway Claims Tribunal, Chandigarh Bench, Chandigarh and vide award dated 4.2.2019, compensation of Rs.8 lacs with interest and costs, was awarded to the applicants. The Tribunal had directed that out of the compensation amount payable to the applicants/awardees, initially a sum of Rs. 75,000/- alongwith proportionate interested accrued thereon, be paid to applicants No. 1 and 4, namely, Rashmi Sharma and Shakuntla and BANITA CHUGH 2019.08.21 16:55 I am the author of this document
CR No. 4203 of 2019 -2with regard to applicants No. 2 and 3, namely, Gaurav Sharma and Saurav Sharma, their share i.e. Rs.1,00,000/- be invested in FDRs in their favour separately, with some Nationalized Bank and left over compensation amount pertaining to applicants Rashmi Sharma and Shakuntla be invested in term deposit in their favour separately, with some Nationalized Bank.
The applicants felt aggrieved by such direction issued by the Tribunal and have approached this Court, by way of filing the present revision petition, praying that the Tribunal be directed to release the entire compensation amount payable to the petitioners. The claimants-petitioners have not approached the Tribunal first, praying for release of entire amount to them in cash and have rather come to this Court directly without availing of the remedy aforesaid.
Therefore, the revision petition is disposed of relegating the revisionists to the remedy of approaching the Railway Claims Tribunal, Chandigarh Bench, Chandigarh, with the similar prayer. It is however, observed that in case the claimants still feel aggrieved, by any order passed by the Tribunal, then they may come to this Court again.
