(ORAL) This appeal is directed against the judgement and order dated 28.04.2022 passed by the learned Single Judge allowing CWP-20513-2020 filed by the petitioners (respondents herein) and quashing as well as setting aside the impugned order dated 09.10.2020 (endorsed on 14.10.2020). Learned counsel for respondent No. 4 has referred to the impugned order dated 09.10.2020 (endorsed on 14.10.2020), whereby some officers of the Border Security Force had been appointed on deputation basis against the vacant posts of Superintendent Central Jails in the Department of Jails, Government of Punjab for a period of three years. The aforesaid period of three years has come to an end on 14.10.2023.
In the present case, the learned Single Judge had quashed the impugned order dated 09.10.2020 (endorsed on 14.10.2020). Notice of motion was issued in the present appeal on 25.08.2022 staying operation of the impugned judgement and order dated 28.04.2022 passed by the learned Single Judge. Since the impugned order dated 09.10.2020 (endorsed on 14.10.2020) was only for a period of three years and it came to an end on 14.10.2023, there is now no cause of action for the State of Punjab to pursue the present appeal any further because they had made the appointments only for a period of three years.
In the circumstances, the appeal is being disposed of as infructuous.
