The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in cross-case dated 17.3.2019 registered for the offences under Sections 323, 324, 148 and 149 IPC (Annexure-P.2) and (Section 326 IPC, which was added later on) (Annexure-P.6), which was got registered by Akashdeep alias Kashi, one of the accused persons in FIR No.36 dated 17.3.2019 (Annexure-P.1) registered for the offences under Sections 323, 324, 341, 452 and 34 IPC and (Section 326 IPC, which was added later on) at Police Station Mehatpur, District Jalandhar. I have heard learned counsel for the petitioner and have gone through the record.
As per the cross-version case, the petitioner is named in the cross-version. He is stated to be armed with a `Khanda' and he gave `Khanda' blows on the head and shoulder etc. of the injured. Cr. Misc. No.M-25588 of 2019 (O&M) [2] DDR and detailed report injuries No.2, 3 and 4 on the person of Akashdeep alias Kashi were found simple and injuries No.1 and 5 to 9 were found grievous.
Keeping in view the facts and circumstances of the present case and the fact that the six grievous injuries have been caused; further the petitioner is required for custodial interrogation and Khanda is still to be recovered, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
