The present petition has been filed by the petitioners under Articles 226/227 of the Constitution of India, seeking a writ of mandamus, directing the respondents to step up the pay of the petitioners at par with their juniors i.e. respondents No.4 and 5, in view of the instructions dated 14.03.2017 (Annexure P-7), clarification dated 10.10.2019 (Annexure P-8), vide which it has been decided to step up the pay of general category employees from the date when the junior employees belonging to reserved category were promoted and as per Note 6 of Rule 7 of the Punjab Civil Services (Revised Pay) Rules (Annexure P-15), the pay shall be stepped up to the same cell in the revised pay structure as that of the juniors, and the petitioners may be granted all arrears of pay and other consequential benefits with interest @ 12% per annum.

Learned counsel for the petitioners submits that for redressal of their grievances, the petitioners have also served a legal VINAY 2026.05.05 10:16 I attest to the accuracy and authenticity of this order/judgment

CWP-13322-2026 -2notice dated 16.10.2025 (Annexure P-14) to the respondents which is still pending consideration. He further submits that at this stage, the petitioners would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said legal notice, by passing a speaking order, in a time bound manner.

On receipt of advance copy, Mr. Siddharth Sandhu, AAG, Punjab, accepts notice on behalf of the respondents. He has no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to decide legal notice dated 16.10.2025 (Annexure P-14) submitted by the petitioners expeditiously, by passing a speaking order after affording an opportunity of hearing to them, preferably within a period of 03 months from the date of receipt of certified copy of this order.
