Mr. Gaurav Gupta, Advocate for the petitioner. **** SANJEEV PRAKASH SHARMA, J.(Oral) Present petition has been filed under section 482 Cr.P.C. for transfer of investigation in case FIR No.0258 dated 21.12.2022 registered under sections 363/366/120-B IPC at Police Station Uttawar, District Palwal (Annexure P-1) and further giving directions to the Court below for again recording statement under section 164 Cr.P.C. of the daughter of the petitioner.
Petitioner by way of this petition has prayed to direct the respondents to record again the statement of his daughter, and also to assess other persons. It is noticed that his daughter and one Rashid had approached this Court in CRWP-12365-2022 seeking protection against the petitioner who was not accepting the marriage. The daughter is major and it seems that the petitioner wants her to go with someone else as his wife. In the petition, the petitioner does not name the person with whom he alleges his daughter to have got married. This Court cannot be a party to such proceeding. This Court cannot be a place where personal scores are to be settled. After some arguments, learned counsel for the petitioner prays to withdraw the petition. However, taking into consideration the case being wholly frivolous, the prayer is disallowed and the cost of Rs.20,000/- is being imposed on the petitioner for filing such frivolous petition. Accordingly, this petition is dismissed with cost of Rs.20,000/- to be deposited with the Punjab & Haryana High Court Legal Services Authority, Chandigarh.
