Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.70 dated 21.07.2021 registered under Sections 306 and 34 IPC at Police Station Hathur, District Ludhiana.

On 13.08.2021, following order was passed:- "The case has been taken up for hearing through video-conferencing.

Learned counsel for the petitioner contends that petitioner is a doctor in Computer Science and is a leading scholar in Punjab

-2University. Father-in-law of the petitioner namely Manjit Singh and deceased Gurmeet Singh were class fellows and residents of the same village. Deceased Gurmeet Singh had borrowed an amount of Rs.9 lacs from Manjit Singh for sending his son abroad. Gurmeet Singh borrowed money from different persons and was under stress of repaying the same.

Allegations are that when the petitioner and his family members asked for the return of the amount, Gurmeet Singh committed suicide by consuming celphos tablets.

Learned counsel further contends that even if the allegation is taken to be on its face value, no offence is made out under Section 306 IPC as there was no concerted effort on behalf of the petitioner to compel the deceased to such an extent where he had no option, but to committ suicide.

Notice of motion for 06.10.2021.

Till the next date of hearing, one time arrangement, petitioner is directed to appear before the SHO/Investigating Officer to join investigation on 18.08.2021 at 11:00 A.M. and in the event of his arrest, he shall be enlarged on interim bail, subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of Arresting Officer. However, petitioner shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Nothing expressed hereinabove shall be

-3construed to be an opinion on the merits of the case. The case shall be decided on merits on the adjourned date."

Learned State counsel on instructions from ASI Jagjit Singh submits that the petitioner has joined the investigation to the entire satisfaction of the Investigating Officer and he is no more required in further investigation of the case. In view of above, order dated 13.08.2021 is hereby made absolute.

However, the petitioner shall keep on joining the investigation as and when required to do so by the Investigating Officer and shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Disposed of.
