In the present writ petition, the petitioner seeks quashing of the show cause notice dated 15.09.2023 (Annexure P-4), the impugned Discharge Order dated 08.05.2024 (Annexure A-8), as well as the judgment/order of the same date i.e. 08.05.2024 (Annexure P-1) passed by the learned Armed Forces Tribunal.

Learned counsel for the petitioner submits that though, as per the respondents, certain benefits have been given to the petitioner, in accordance with his pensionable service but according to his instructions, no benefit has been extended to the petitioner but as a statement has been made by the learned counsel for respondents at the bar qua all the benefits already given to the petitioner, liberty be given to the petitioner that in case any more relief for which the petitioner is entitled for, is yet to be released, the petitioner will file an appropriate representation, which representation will be decided in a time bound manner by passing a speaking order. Learned counsel for the respondents submits that in case any representation is received at the hands of the petitioner, the same will be decided by the competent authority within a period of eight weeks from the date of receipt of any such representation and in case, it is found that the relief claimed is admissible, the same will be extended to the petitioner otherwise due reasons will be mentioned for not accepting the claim of the petitioner, which reasons will be conveyed to the petitioner for his information and necessary action.

Learned counsel for the petitioner submits that keeping in view the statement made by the learned counsel for the respondents, the present petition may kindly be disposed of having been not pressed any further with liberty as prayed for.
