The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of charge-sheets dated 17.07.2019 and 18.07.2019 as well as order of punishment of 03 days RI. 2.

The petitioner is serving in Indian Army. The case of the petitioner falls within the definition of service matters as contemplated by Section 3(o) of AFT Act, 2007. This Court vide order dated 03.10.2023 passed in CWP No.3118 of 2023 has held that AFT has jurisdiction over matter like involved in the present case.

Faced with this, learned counsel for the petitioner submits that the matter may be transferred to AFT, Chandimandir. 4.

Learned counsel for the respondents does not dispute the aforesaid prayer.
