*** In the present petition, State of Haryana has challenged the award dated 10.10.2012 (Annexure P-1) vide which the services of workman-respondent No.1 were held to be terminated illegally, therefore, he was entitled to be reinstated in service with continuity with payment of 50% back wages from the date of issuance of demand notice dated 24.11.1999. When the award was challenged, no stay was granted. On 01.07.2013, the following order was passed by the Hon'ble High Court: "Since in compliance of the impugned award dated 10.10.2012 (Annexure P-1), the respondent workman has already been allowed to join the services, though on provisional basis, no case for staying of the impugned award is made out."
State counsel on instructions from Mr.Ashwani Kumar Clerk, o/o DFO, Charkhi Dadri, has stated that respondent No.1 had retired from service and is getting all pensionary benefits and nothing is due/payable to him and therefore, the present petition be disposed of accordingly.
