The petition has been filed for temporary release of the petitioner for four weeks to attend the last rites of his father which are fixed for 15.10.2016. The father of the petitioner, according to the Death Certificate (Annexure P1), died on 04.09.2016.

The petitioner himself has stated that as per provisions of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988, he can avail parole for emergency purpose under Section 3(1)(a) thereof. Crl.WP No.1287 of 2016 [2] Learned counsel for the petitioner, in the circumstances, prays that he may be allowed to withdraw the writ petition and approach the Superintendent Jail for temporary release of the petitioner on parole so as to attend the last rites of his father.

In case such an application is filed, the competent authority shall consider and decide the same before 15.10.2016, the date that is fixed for last rites of the father of the petitioner.
