**** RITU BAHRI , J. (Oral) Quashing of FIR No. 881 dated 17.12.2018 under Sections 354A (2)/354-D/506 IPC, registered at Police Station Bhiwani City, District Bhiwani, is being sought on the basis of compromise deed dated 03.07.2020 (Annexure P-2).
The above mentioned F.I.R was got registered on the complaint made by respondent No. 2 with the allegations that the petitioner stalked her and touched her with intent to harass her sexually and also gave her criminal intimidation.
However, with the intervention of respectables of the Society, the matter has now been duly compromised, on the basis of compromise deed dated 03.07.2020 (Annexure P-2). The petitioner made a promise that he will not reiterate such type of incident. The compromise is without pressure and has been duly signed by both the parties.
Learned counsel for respondent No. 2 admitted the factum of compromise and has stated that the parties have settled their dispute amicably and respondent No. 2 do not want to pursue with the case against the petitioner. She has no grievance against the present petitioner. Aadhar card of respondent No. 2 has been placed on record as Annexure P-3 in the present petition.
In compliance of order dated 17.09.2020, a status report dated 01.10.2020 has been received from CJM, Bhiwani. As per this report, the parties have appeared before the Court and they have stated that they have entered into compromise voluntarily, without any pressure and coercion. The compromise is genuine and without any pressure. Respondent No. 2 has no objection if the F.I.R be quashed by this Court against the petitioner. Statement of accused-Vinod was also recorded to the effect that the matter has been compromised between the parties. The compromise is genuine and without any pressure.
Keeping in view prevailing COVID-19 situation and the fact that the status report dated 01.10.2020 has been received to the effect that the compromise has been effected between the parties vide compromise deed dated 03.07.2020 (Annexure P-2) it is a fit case where there is no impediment in the way of the Court to exercise its inherent powers under Section 482 Cr.P.C for quashing of F.I.R in the interest of justice. Consequently, in view of the judgment of the Hon'ble Supreme Court in cases of Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429 and the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging
the litigation.
Accordingly, FIR No. 881 dated 17.12.2018 under Sections 354-A (2)/354-D/506 IPC, registered at Police Station Bhiwani City, District Bhiwani, is quashed along with all consequential proceedings arising therefrom qua petitioner.
The petition stands disposed of.
