LISA GILL, J. (Oral) This petition has been filed challenging order dated 05.06.2017 passed by the learned Additional Sessions Judge, Sonepat, whereby the application for release of the vehicle i.e. Swift VDI car No. HR10Y-6381 on superdari has been dismissed on the ground that the same is case property and it would not be appropriate to release it on superdari. The petitioner is stated to be the registered owner of the abovesaid vehicle. Learned counsel for the petitioner submits that the petitioner has since been acquitted by the learned trial Court vide order dated 06.11.2017. This petition has in fact been rendered infructuous but vide judgment dated 06.11.2017, no direction has been given for release of the vehicle in question neither has it been confiscated. CRR No. 2441 of 2017 [ 2 ] being released to the petitioner. It is, thus, prayed that the vehicle in question be released.
Certified copy of the judgment dated 06.11.2017 acquitting the petitioner in FIR No. 593 dated 27.10.2016 under Sections 323, 376, 506 IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocitie) Act, 1989 registered at Police Station City Sonipat is taken on record subject to just exceptions. It is noted that there is no order for confiscating the vehicle in question. Admittedly, the petitioner has been acquitted. This petition is thus disposed of with a direction for release of the vehicle in question in accordance with law.
