ARVIND SINGH SANGWAN, J. (Oral) The petitioner pray for grant of anticipatory bail in FIR No.395 dated 24.11.2017, registered under Section 61/1/14 of the Punjab Excise Act, at Police Station Sadar Nakodar, District Jalandhar. The operative part of the order dated 01.03.2018, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner submits that the petitioner was not apprehended at the spot and the recovery has already been effected.

Notice of motion for 11.05.2018."

Counsel for the petitioner submits that the petitioner, in pursuance to the order dated 01.03.2018, has already appeared before the Investigating Officer and has joined the investigation. Counsel for the State, on instructions from HC Sarabjit Singh, has not disputed the factual position and submits that the petitioner have joined the investigation and is no more required for any MOHD YAKUB 2018.08.21 15:49 I attest to the accuracy and authenticity of this document Chandigarh

In view of the above, the petition is allowed and the interim bail granted to the petitioner vide order dated 01.03.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
