CRM-27801-2017 Criminal Misc. Application is allowed, subject to all just exceptions. Document (Annexure A1) is taken on record. CRR-2491-2017 Present petition is for release of petitioner on bail, whose application for exemption was declined by the learned Court below. Learned counsel for the petitioner contended that bail of coaccused, namely Rajiv Gambhir was also cancelled by the learned Court below and this Court, vide order dated 25.5.2017, ordered him to surrender before the learned trial Court and in that eventuality admit him on bail. This Court has considered the facts in its entirety. The petitioner, has earlier moved an application for seeking his exemption from personal appearance in the Court and the same was allowed. Criminal Revision No. 2491 of 2017 (O&M) another application was filed before the learned Court below for granting him exemption from his personal appearance on the ground that he was travelling to Calcutta for some business purpose and as such he could not appear before the Court. There is no ground for recalling or setting aside of the order dated 3.2.2017, passed by the learned Court below and there was no justified ground for seeking exemption from his personal appearance and the learned trial Court has rightly passed the impugned order. Thus, there is no ground to set aside the impugned order and the present petition stands dismissed.
