(Presence marked through video conference) *** ARUN MONGA, J. (ORAL) Petitioner herein inter alia seeks issuance of a writ in the nature of mandamus directing the respondents to grant him additional 5 marks towards socio economic criteria.

Learned counsel for the petitioner submits that petitioner has secured 76 marks as per answer key uploaded by the Commission and the last candidate under waiting list of EWS Category has secured 80 marks. If petitioner is given 5 marks towards socio economic criteria, as no one in his family in Government job, then he will be in the selection zone for the post in question.

Learned counsel for the petitioner submits that qua his aforesaid grievance, petitioner approached respondents many a times but to no avail. Hence, the instant petition.

On advance service, learned State counsel joins proceedings and opposes the issuance of notice of motion. She submits that per her instructions, petitioner was not found eligible as his EWS certificate was not VANDANA 2021.10.13 13:01 I attest to the accuracy and integrity of this document

valid. She further submits that competent authority, however, shall take decision either way, by treating the writ petition as a representation. 5.

At this stage, learned counsel for the petitioner also agrees that let a final decision be taken, by the competent authority by treating the writ petition as his representation.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner by keeping in view the contentions raised in the present petition by treating the same as a representation and take a decision, in accordance with law.

Let the needful be done within a period of 02 months from today.

Disposed of accordingly.
