The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of: i) Charge sheet dated 13.03.2018 (Annexure P-3); and ii) Order dated 09.11.2021 (Annexure P-12) whereby he was dismissed from service He is further seeking direction to respondents to reinstate him with all consequential benefits along with interest. 2.

During the pendency of instant petition, the petitioner was acquitted vide judgment dated 07.06.2023 passed by Judge Special Court, Hoshiarpur. The respondent on account of petitioner's acquittal reinstated him in service vide order dated 20.06.2024 and permitted to rejoin on 02.08.2024. He has been denied back wages on the principle of 'no work no pay.' The out of service period has been treated as non-duty period. CWP No.12660-2023(O&M) -2petitioner remained under suspension from 22.02.2018 to August' 2018. He remained under compulsory retirement from 25.01.2020 to 21.03.2021. He further remained dismissed from 09.11.2021 to 02.08.2022. 3.

By order dated 20.06.2024, the petitioner has been reinstated, however, denied back wages. His absence period has been treated as on-duty period.

On being confronted with the fact that order dated 20.06.2024 passed during the pendency of instant petition is not under challenge, Mr. R.K.Arora, Senior Advocate seeks permission to withdraw the petition with liberty to file afresh with better particulars. 5.

Dismissed as withdrawn with aforesaid liberty. 6.
