This petition has been filed under Section 482 of BNSS (erstwhile 438 Cr.P.C) for grant of anticipatory bail to the petitioner in case FIR No. 166 dated 28.09.2017 under Section 21, 29/61/85 of NDPS Act registered at Police Station Lopoke District Amritsar Rural.

Learned counsel for the petitioner submits that the petitioner was granted the concession of anticipatory bail in CRM-M-39173-2018 decided on 12.10.2018. Thereafter, the petitioner had been appearing before the trial Court but could not appear before the Court below on 22.04.2026 as he was out of station regarding harvesting of the crops in Madhya Pradesh. As such the Court below cancelled the bail orders of the petitioner and his bail bonds and surety bonds were ordered to be forfeited. Non-bailable warrants of arrest against the petitioner have been issued. He further contends that the petitioner may be permitted to surrender before the learned trial Court to attend the trial proceedings regularly and, therefore, requests that the impugned order may be set aside.

On the asking of the Court, Mr. P.S.Pandher, Assistant AG Punjab accepts notice on behalf of the respondent-State. 5.
I have heard the submissions made by the learned counsel for the petitioner and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 05.05.2026 passed by the learned Judge, Special Court, Amritsar. However, in case the petitioner surrenders before the Court below within 07 days from today and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same within a period of 03 days. 7.
The petition stands disposed of.
