(ORAL) Through this petition under Section 482 Cr.P.C., the petitioner has prayed for issuance of directions to respondents No. 2 and 3, to initiate proceedings under Section 340 Cr.P.C., against respondents No. 4 and 5, who after taking undue advantage, misled this Court, by adducing fake documents, on the basis of which this Court had granted the relief to respondents No. 4 and 5, vide order dated 10.01.2018 (Annexure P-1) passed in CRM-M-672-2018 (Annexure P-2). Heard.
From the record, this Court finds that respondents No. 4 and 5, have filed CRM-M-672-2018, in this Court for seeking direction to protect their lives and liberty. The present petitioner was also arrayed as respondent No. 5 in the said petition being mother of respondent No. 5 RISHU KATARIA 2019.04.03 15:34 I attest to the accuracy and integrity of this document
CRM-M-8756-2018 -2- -Rajwinder Kaur. No finding was given in that petition regarding the validity of marriage. The Court has also not determined any fact qua the age of respondent No. 5, on the basis of alleged wrong Aadhaar Card. Therefore, there is no necessity to take action or initiate proceedings under Section 340 Cr.P.C.
