Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No.165 dated 22.12.2018, under Sections 21, 22 and 29 of the NDPS Act, registered at Police Station Barnala, District Barnala.
Learned counsel for the petitioner contends that the petitioner was not named in the FIR, wherein as per secret information, it was informed that Bholi Kaur and her son namely Jita Singh were engaged in selling of intoxicant tablets. Acting upon the same, the raid was conducted at the residence of Bholi Kaur and the alleged contraband was recovered. It is contended that the co-accused namely Jita Singh has already been granted bail by this Court on 05.04.2019 passed in CRM-M-11929-2019 on the ground that he was already in custody when the alleged recovery was Sheetal Gawri 2019.07.18 15:25 I attest to the accuracy and integrity of this document Chandigarh effected. He submits that the petitioner was also not at home when the raid

On the other hand, bail application is opposed by learned State counsel. It is not disputed that the petitioner was not present at home when the alleged recovery was effected.
Considering the above background and the fact that the trial is likely to take some time, further detention of the petitioner may not be justified. Therefore, without meaning any expression of opinion on the merits of the case, it is ordered that the petitioner be released on regular bail subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court concerned.
The petition is allowed.
