(Oral) Learned counsel for the petitioner has contended that the civil litigation is already going on between the parties and stay order dated 08.02.2024 had already been passed in favour of the petitioner by Court of learned ACJ (SD), Tarn Taran, against legal heirs of Gurmukh Singh wherein petitioner's possession of said Khasra number was acknowledged by the Court. He further contended that when the petitioner received threats from respondent No.6 and 7 regarding taking forcible possession of aforesaid land, petitioner again obtained a stay order dated 14.06.2024 from Court of learned ACJ (SD) Tarn Taran and Court acknowledged possession of petitioner over the said land. When respondent Nos.

6 and 7 threatened the petitioner to forcibly dispossess him from said land, petitioner filed stay petition against respondent No.6 in which respondent No.6 is appearing through his counsel and he got a false mutation sanctioned in his favour by presenting a forged Will allegedly executed by Jyoti 2025.05.

CRWP-4821-2025 (O&M) Gurmukh Singh and started threatening to sell the said land. The petitioner has got a stay order dated 06.09.2024 in his favour against respondent No.6 passed by the court of learned Additional District Judge, Tarn Taran. He argued that despite being fully aware about the aforesaid stay order passed by various Courts in favour of the petitioner, respondent No.4 forcibly interfered with the petitioner's possession of the property, regarding which the petitioner had filed contempt petition regarding violation of the Court order.

During the course of arguments, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a fresh petition by availing efficacious alternative legal remedy available to the petitioner, if need arises.
