Present revision petition has been preferred by the petitionertenant herein challenging the orders dated 31.03.2015 and 23.03.2023. The Rent Controller vide order dated 31.03.2015 had fixed the fair rent of the shop in dispute as Rs.1545/- excluding the house tax. Aggrieved by the same an appeal was preferred which appeal was dismissed by the Appellate Authority vide order dated 23.03.2023.

Learned counsel for the petitioner-tenant would contend that the fair rent has erroneously been fixed and both the Authorities have erred in relying upon Ex.R5 and Ex.R6 in fixing the fair rent. 3.

In the present case the respondent-landlord had placed on record the rent receipts (Ex.R5 and Ex.R6) coupled with the fact that it has been stated in the reply filed by the respondent-landlord that the mutually enhanced rent was Rs.1500/- per month excluding the house tax. The same was treated as the basic rent. Learned counsel for the petitioner-tenant has JITENDER KUMAR 2024.10.03 10:26 I attest to the accuracy and integrity of this order/judgment.

CR-5766-2024 -2not been able to show any evidence led by the petitioner-tenant herein to counter the receipts (Ex.R5 and Ex.R6).

In view of the above, I do not find any merit in the present petition and the same being devoid of any merit is accordingly dismissed. Pending applications, if any, also stand disposed off.
