The present petition has been filed seeking issuance of direction in the nature of Mandamus for directing the Central Administrative Tribunal (for short Tribunal) to take up OA No.530-2021 for an early date and decide the same on its merits.

Learned counsel for the petitioner submits that despite retirement in 2011 i.e. about fifteen years ago, the retiral benefits have been withheld due to pendency of certain criminal proceedings, and the petitioner had filed an original application five years ago being OA No.530 of 2021, titled Krishan Chand Choudhary Vs. Union of India, which is still pending consideration and the pendency of the same is causing prejudice, hence, the Tribunal be directed to decide the said OA at the earliest so that petitioner does not face any further prejudice.

Keeping in view the innocuous prayer made, coupled with the fact that the original application is still pending before the Tribunal despite lapse of five years and is now fixed for 07.08.2026, Tribunal is requested to make all the efforts to decide the same so that the petitioner should know the status qua the grant of pensionary benefits.
