This is a prayer for grant of parole to the petitioner so as to enable him to take care of his ailing father. Learned counsel for the respondents has filed reply on behalf of respondent No.3 by way of affidavit of Rattan Singh, Superintendent, District Jail, Yamuna Nagar wherein it has been stated that infact the petitioner has never moved an application for seeking parole on the ground taken up by him in the writ petition. The prayer has been made to the Jail Authorities to release him in order to enable him to file proceedings in the Hon'ble Supreme Court.

Evidently, plea of the father's ailment has been conjured up by the petitioner. However, we do not comment on this aspect any further. Criminal Writ Petition No. 1583 of 2016 brother, who is about 30 years of age and is capable of taking care of his father.

At this stage, learned counsel for the petitioner prays that he may be permitted to withdraw the instant writ petition with liberty to approach the respondents with the pleas taken here. In view of above, the instant writ petition is dismissed as withdrawn with the liberty aforesaid.
