**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner is claiming the selection grade of `7500-12000 w.e.f. 01.01.1996 instead of 01.08.2000 to the 20% of the posts. In support of his claim, the petitioner is relying upon an order passed by this Court in CWP No.8082 of 2001 titled 'R.K. Verma and others Vs. State of Haryana and another', decided on 01.12.2010 (Annexure P-3).

Counsel for the petitioner states that the abovesaid judgment has already attained finality and the similarly situated persons have already been granted the relief.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, petitioner has served respondents with a legal notice on 07.03.2019 (Annexure P-9), which is NARESH KUMAR 2019.07.01 16:40 I attest to the accuracy and integrity of this document Chandigarh

CWP-16437-2019 -2still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 07.03.2019 (Annexure P-9) by passing a speaking order within a period of two months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next two months.

It is made clear that in case the petitioner is found entitled for the benefit as claimed, the arrears shall be restricted from the date of serving of the legal notice as admittedly the petitioner never approached the authorities for the grant of relief, as being claimed in the present writ petition prior to the year 2019 in any manner. Present writ petition stands disposed of.
