On 16.09.2020, the following order has been passed by this Court:- The petitioner-husband prays for grant of pre-arrest bail in a criminal case arising from FIR No.123, dated 29.07.2020, registered under Section 307 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959, at Police Station Sadar Malout, District Sri Muktsar Sahib.
As per case of the prosecution, the petitioner fired two bullets from his licenced .12 bore gun, which hit the first informant (the petitioner's wife) on her left upper arm and left flank.
Learned counsel for the petitioner contends that the FIR was wrongly registered as it was a case of accidental fire when DEEPAK KUMAR BHARDWAJ 2020.10.01 10:58 I attest to the accuracy and integrity of this document
Criminal Misc. No. M- 28045 of 2020 the petitioner was cleaning his double barrel .12 bore gun. It is claimed that the first informant-Sukhpreet Kaur @ Rani has submitted an affidavit to that effect.
Notice of motion.
Mr. Saurav Khurana, DAG, Punjab, accepts notice on behalf of State of Punjab and submits that there is some sort of settlement between the first informant and the petitioner. Adjourned to 30.09.2020.
In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C."
Ms. Samina Dhir, Deputy Advocate General, Punjab, on the instructions from Sub Inspector Rachpal Singh, has submitted that the petitioner has joined investigation, co-operated and not required for further custodial interrogation.
In view of the aforesaid facts, the present petition is allowed and interim pre-arrest bail granted to the petitioner by this Court on 16.09.2020 is made absolute.
