Both the above-mentioned cases are taken up together as these have arisen from same FIR.

Petitioners have filed these petitions under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.92 dated 15.07.2016 under VINEET GULATI 2019.07.19 12:43 I attest to the accuracy and authenticity of this document Chandigarh Sections 307, 325, 324, 323, 341, 148, 149 IPC and Section 3 of Scheduled

CRM No.M-25947 of 2019 and connected petition -2Castes and Scheduled Tribes (Prevention of Atrocities) Act, registered at Police Station Kharar, District Mohali.

Notice of motion were issued. Learned State counsel appeared and contested the petitions.

I have heard learned counsel for the petitioners as well as learned State counsel and have gone through the record. As per FIR, there were about 30-35 persons, who took part in the occurrence. The petitioners are not named in the FIR. No injury has been declared dangerous to life. Moreover, no specific injury has been attributed to the petitioners.

The petitioners have already joined the investigation. They are not required for custodial interrogation. Nothing is to be recovered from them. No useful purpose will be served by sending and keeping the petitioners in custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 31.05.2019 in CRM No.M-25947 of 2019 and order dated 05.07.2019 in CRM No.M-28158 of 2019 granting interim bail to the petitioners, are made absolute.
