Prayer in the present writ petition filed under Articles 226/227 of the Constitution of India is for issuance of a writ in the nature of mandamus directing respondent No.2 to hear and decide Appeal No.4 of 2026 (Annexure P-2) filed by the petitioner under the Punjab Village Common Lands (Regulation) Act, 1961 in a time bound and expeditious manner. 2.
Learned counsel for the petitioner would contend that the order (Annexure P-1) was passed on 27.11.2025 by the District Development and Panchayat Officer, Hoshiarpur. The said order was challenged by the petitioner by filing an appeal bearing Appeal No.4 of 2026 on 09.02.2026 before respondent No.2-Director, Rural Development and Panchayat Department concerned which has not been taken up till date. Learned counsel would further contend that neither the application for stay has been taken up AMAN JAIN 2026.05.01 09:16 I attest to the accuracy and integrity of this order/judgment
CWP-13448-2026 (O&M) -2nor the appeal has been dealt with and the respondents are going to take possession of the property today.

In view of the above and without commenting upon the merits of the case, the present writ petition is disposed off with a direction to respondent No.2-Director, Rural Development and Panchayat Department to decide the application for stay as expeditiously as possible, preferably within a period of two months from today. Till such time the application for stay is decided, dispossession of the petitioner herein shall remain stayed. 6.
