******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in Criminal Appeal No. 654 of 2016 titled as Kanwar Raj Singh Vs. Saroj Bala etc. filed in COMA No. 45499 of 2012 dated 07.08.2012 titled as Saroj Bala and another Vs. Kanwar Raj Singh for the offences punishable under Sections 138 of Negotiable Instruments Act and 420 of Indian Penal Code at Police Station Division No. 7, Ludhiana, District Ludhiana. Heard.

In view of above facts but without expressing any opinion on the merits of the case, this petition is allowed and the order dated 01.03.2018 is made absolute subject to the condition that petitioner will keep on appearing before Lower Appellate Court on each and every date of hearing. In the event of his non-appearance on any date without permission, Lower Appellate Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
