Mr. Sherry K Singla, Advocate for the petitioners. GURVINDER SINGH GILL, J (ORAL) The petitioners seek quashing of FIR No.213 dated 26.10.2017 under Sections 420/120-B IPC, Police Station City South, District Moga and all other consequential proceedings arising therefrom. The allegations in nutshell are that the FIR was lodged at the instance of Parveen Kumar wherein he has alleged that mutation in respect of property of his father has been got sanctioned by Tirath Ram and his wife namely Ranjana Devi in their favour on the basis of a forged WILL. Learned counsel for the petitioners has, submitted that the aforesaid allegations are incorrect inasmuch as the mutation has been sanctioned on the basis of natural inheritance and there is no such WILL as alleged in the FIR.
Having heard the submissions made by learned counsel for the petitioners, this petition is disposed of with liberty to the petitioners to raise all the points as raised before the trial Court at the time of framing of charge. Needless to mention that the trial Court shall pass speaking order while considering all the allegations raised by the petitioners at the time of framing of charge.
