RAMENDRA JAIN, J. (ORAL) Prayer through this petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to petitioner Surinder Kumar @ Sukhwinder Singh @ Sukhi in case FIR No.92 dated 07.07.2017 registered under Sections 458, 380 and 411 IPC at Police Station City Jalalabad, District Fazilka.
According to the prosecution, petitioner has been booked in the FIR aforesaid on the allegation that he purchased the stolen A.C. Learned counsel for the petitioner inter alia contends that petitioner has been falsely implicated in this FIR. Petitioner purchased the A.C. without knowing the fact that the same was stolen. He has no role in the alleged theft.
On the other hand, learned State counsel vehemently opposed the bail application.
