The petitioners have filed this petition under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to pay the compensation to the petitioners whose land has been acquired vide notification dated 19.5.2021 alongwith interest @ 18% and or in alternative to quash the award dated 20.9.2022, which has been passed in violation of the provision of the right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013; alongwith certain other prayers.

CWP No. 12651 of 2023 -2- 2024:PHHC:046170 Shahpurkandi Township, Tehsil and District Pathankot, on behalf of respondent No.3, alongwith copy of speaking order dated 17.08.2023, passed by Land Acquisition Collector, Shahpurkandi Dam Project, has been filed by learned State counsel today in Court. The same is taken on record. Registry is directed to scan the same and place it at appropriate place. 3.

Learned State counsel has submitted that since there was dispute regarding apportionment of compensation payable qua the land comprised in the Khewat(s) involved in the writ petition, therefore, the competent authority has sent a reference to the Reference Court and the amount of compensation has also been deposited with the Said Court. 4.

In view of the above, this Court does not find any ground to continue with the present petition any more. Therefore, the same is dismissed.

However, the petitioners would be at liberty to avail their alternate remedies and pleas, before the competent authority.
