1. Through the instant petition, as instituted under Section 438 of the Cr.P.C., the petitioner seeks the concession of anticipatory bail, in case FIR No.18 dated 07.02.2024, under Sections 452, 326, 323, 324, 295, 148, 149 of the IPC, registered at P.S. Sadar Khalra, District Tarn Taran.
2. The learned counsel for the petitioner submits that, although specific injury has been attributed to the petitioner, but, the present FIR suffers from the vice of delay, inasmuch as, it has been registered after delay of approx. 3 months, which renders it to be the outcome of premeditation and concoction. Therefore, the story put forward in the FIR is surrounded by clouds of suspicion.
3. Notice of motion for 22.07.2024.
4. Mr. Pardeep Bajaj, D.A.G., Punjab, accepts notice on behalf of respondent-State of Punjab.
5. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called DEVINDER YADAV 2024.07.30 12:59 I attest to the accuracy and authenticity of this order/judgment
upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 438(2) Cr.P.C.
