Letters Patent Appeal No. 880 of 2023 (O&M) Date of Decision: 13.07.2023 Manjinder Singh .....Appellant versus State of Punjab and others .....Respondents

CORAM:

HON'BLE MR.JUSTICE RAVI SHANKER JHA, CHIEF JUSTICE HON'BLE MR. JUSTICE ARUN PALLI, JUDGE Present :

Mr. Nand Lal Sammi, Advocate and Mr. Hitesh Kumar Sammi, Advocate, for the appellant. Mr. Arjun Sheoran, Deputy Advocate General, Punjab. **** This appeal has been filed by the appellant being aggrieved by the orders dated 01.05.2023 and 12.05.2023 passed by the learned Single Judge in Civil Writ Petition No. 9211 of 2023 dismissing the petition filed by the appellant-petitioner praying for quashing the compassionate appointment granted to the widow of his brother (respondent No.4). 2.

Learned counsel for the appellant after arguing at length submits that the appellant gives up his claim for assailing the impugned orders passed by the learned Single Judge on-merits and accepts the same. He, however, submits that huge costs imposed upon the appellant by the learned Single Judge be reduced or waived off as the appellant-petitioner was under the bona fide belief that he has a good case and therefore, had approached this Court.

3.

Having heard learned counsel for the appellant and looking to the pecuniary condition of the appellant, while we do not interfere in the impugned orders passed by the learned Single Judge on-merits, the costs imposed upon the appellant is reduced to Rs.5000/-. 4.

With the aforesaid modification, the appeal stands disposed of. (RAVI SHANKER JHA) CHIEF JUSTICE (ARUN PALLI) JUDGE 13.07.2023 ravinder Whether speaking/reasoned √Yes/No Whether reportable Yes/No√ RAVINDER KUMAR 2023.07.14 16:55 I attest to the accuracy and authenticity of this order/judgment.
