The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking a writ of mandamus, directing the respondents to consider and promote the petitioner to the post of Principal (School Cadre) from the date persons junior to him including respondents No.3 to 6, who have been promoted as Principals, on the basis of seniority list dated 20.11.2015 (Annexure P10), which has been quashed by this Court, vide order dated 27.02.2023 (Annexure P-17) and revised seniority list dated 13.11.2025 (Annexure P-20) had been issued placing the petitioner above them in the seniority list, and the petitioner be held entitled for all consequential benefits i.e. seniority and pay fixation from the date respondents No.3 to 6 have been promoted to the post of Principal and the petitioner be granted revised retiral benefits with 9% interest. A further prayer has been made to quash the promotion of the juniors, if post is needed for giving promotion to the petitioner.

Learned counsel for the petitioner submits that for redressal of his grievances, the petitioner has also served a legal notice dated 02.03.2026 (Annexure P-21) to the respondents which is still pending consideration. He further submits that at this stage, the petitioner would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said representation, by passing a speaking order, in a time bound manner.

On receipt of advance copy, Mr. Kanav Singla, AAG, Punjab, accepts notice on behalf of respondents No.1 and 2. He has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide the legal notice dated 02.03.2026 (Annexure P-21) submitted by the petitioner expeditiously, by passing a speaking order after affording an opportunity of hearing to him, preferably within a period of 03 months from the date of receipt of certified copy of this order.
