**** RITU BAHRI, J. (Oral) Petitioner is seeking directions to the respondents to consider release on the basis of his physical health conditions during the sentence under Chapter XV, Sub-Para V of Para 516-B of Punjab Jail Manual. Upon notice, reply has been filed by way of affidavit of Joga Singh, Superintendent of Central Jail, Bathinda, on behalf of respondent Nos. 1 and 3.
As per reply, the petitioner is undergoing rigorous imprisonment for 10 years under Section 376 IPC. As per the medical report (Annexure R-1), the petitioner had been suffering from Tuberculosis Abscises Left Scapular Region (Extra-Pulmonary) and was treated completely from T.B. Hospital, Bathinda from 27.09.2014 to 11.03.2015. As per health record card, now he is not suffering from any significant disease.
In view of above-said facts, no order is required to be passed in the present petition and accordingly the same is hereby dismissed.
