  Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.64, dated 02.06.2021, having been registered at Police Station Sadar Jalalabad, District Fazilka, alleging therein the commission of an offence punishable under Section 21 of the NDPS Act, 1985.

Learned counsel for the petitioner submits that the quantity of heroin allegedly recovered from the petitioner as per the FIR is well below commercial quantity and therefore he should be admitted to bail. However, it is not denied that there are three other criminal cases registered against the petitioner, two under the provisions of the NDPS Act and DINESH 2021.09.29 20:02 I attest to the accuracy and integrity of this document

CRM-M-33294 of 2021 -2one under the provisions of the Punjab Excise Act, 1914. That being so, and the period of custody in the present case being only 3 months, I see no ground to entertain this petition which is consequently dismissed at this stage.
