**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 90 dated 08.7.2020 under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Jagadhri Sadar, District Yamuna Nagar. Learned counsel for the petitioner submits that the alleged recovery effected from the petitioner falls under the non-commercial quantity and he has been in custody since 08.7.2020 and there is no other case pending against him.

Learned State counsel has not disputed the fact that the recovery effected from the petitioner falls under the non-commercial quantity and no other case is pending him. He further submits that out of 18 prosecution witnesses, none has been examined as on date. CRM-M No. 29006 of 2020 -2custody since 08.7.2020. Moreover, out of 18 prosecution witnesses, none has been examined so far. The trial will take time to conclude because of COVID-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds and surety bonds to the tune of Rs. 2.00 lacs to the satisfaction of the trial Court/Duty Magistrate, keeping in view the fact that he is the resident of Nepal.
