Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.203 dated 18.12.2017 registered under Sections 489-B and 489-C IPC at Police Station Dasuya, District Hoshiarpur.
Learned counsel submits that petitioner is incarcerated since 18.12.2017. He further submits that offence under Section 489-C is bailable. Petitioner is alleged to have been in possession of fake currency i.e. nine notes of Rs.2000/- each and four notes of Rs.500/- each, total Rs.20,000/-.
Admittedly, investigation is complete. Trial is in progress, which may take some time to conclude.
In view of the above, no useful purpose would be served by detaining the petitioner any longer. However, petitioner is stated to be a resident of Bihar. Thus, trial court would enlarge him on bail subject to stringent conditions.
Petition is allowed in these terms.
